What should I do if I am involved in an Automobile Accident?

If you are involved in an automobile accident, you should take the following advice:

1) Do not panic – You must remain at the location of the accident (regardless if you were right or wrong).  Basically, leaving the scene of the accident can cause you two problems = one is that it is a criminal offense to “Leave the Scene of an Accident.” This can cause you serious problems, including arrest and possible suspension of your license.  If you are a visitor to this country, you may be risking problems with the Department of Homeland Security (“La Migra”).  Secondly, if you leave the scene of an accident, it may be implied in a civil case that you left the scene because you were responsible for the accident.

2) Speak politely to the police officers.  Generally speaking, this is not the most exciting part of their job.  They usually wish to take the facts from both drivers and complete a report.  If you have any proof that supports your version (e.g.’ videos of the accident on dashboard camera, independent witnesses at scene) be sure to inform the police of this evidence.

3) Take photos of the damage of all cars involved in the accident.  Save the photos for future reference.

4) If you are injured, be sure to take an ambulance to the hospital.  Do not attempt to drive yourself to a hospital.  The auto insurance from your vehicle will cover the ambulance.

5) When you return from the Emergency Room, be sure to contact a lawyer who specializes in Accident cases.  An lawyer who has experience with accident cases will be able to provide you with the proper forms to obtain “No Fault Insurance.”  A lawyer who has years of helping injured persons will help you through the process.
